Russian FaceApp Now Has Pictures of Over 150 Million People

FaceApp is based in St. Petersburg, Russia and over 150 million people have uploaded faces and names to the app.

FaceApp owns a never-ending and irrevocable royalty-free license to do anything they want with the pictures and data.

This brings to mind the Game of Thrones Arya Stark- Faceless Men Assassin images.

  1. Pictures of a person are not hard to get. Neither is their credit card number or their bank account number or their Social Security number. But just because you have them stored on your device does not give you the rights to do anything you want with them.

    That’s a very important distinction.

If someone wants your permission to do whatever they want with your image, tell them to forget it. Or else pay you and offer a contract that very specifically states how they can use that photo, where they can use that photo, how long they can use that photo, and when and under what circumstances the rights revert to you. And how much you get from royalties, residuals, merchandising fees, etc.

That doesn’t stop people from using it if they want to, but there is a significant distinction in whether or not they have permission to do so. Just as there is a significant distinction in whether or not you gave them permission to use your credit card number.

  2. So what, those 150million people agreed to the EULA, just like they do when they use every other online service in the world.

If i take a picture of you, i own a never-ending and irrevocable royalty-free license to do anything I want with it.

  3. Facebook’s terms of service: “You own all of the content and information you post on Facebook.“

  4. Facebook and Google have photos of seven billion people.

“oh, but they have different eulas”

    Right. As if that mattered.
